Snapsale is a registered trade name of Westcube B.V. (trading as Snapsale) and attaches great importance to the protection of your privacy. In this Privacy Policy, we explain which personal data we collect, for what purpose, and how we secure it in accordance with the General Data Protection Regulation (GDPR).

2. Processing of Your Data (As Data Controller)
Snapsale processes the following categories of your personal data. This concerns the data you provide directly for your subscription and use of the service.

3. Processing of Photos (Your Uploads)
Regarding the photos you upload for editing, Snapsale acts in a different capacity:
3.1. Role of Snapsale
The interior photos you upload are processed by Snapsale solely on your behalf as the Customer. Therefore, Snapsale acts as a Processor and you are the Data Controller.
3.2. Basis and Purpose
The processing of these photos (including any personal data therein) is solely for the performance of the contract between you and Snapsale.
3.3. Photo Retention Period
Uploaded photos and edited results are retained for a maximum of 7 (seven) days. After this period, all photos are automatically and permanently deleted from our systems, including cache and temporary processing files.
3.4. Detailed Arrangements
The detailed arrangements regarding the processing of these photos (security, LLM usage, rights and obligations) are set out in the Data Processing Agreement (DPA), which forms an integral part of our Terms of Service.
4. Sharing Data with Third Parties
Snapsale only shares your data with third parties if this is necessary for the execution of the Service, to comply with a legal obligation, or with your consent.

Sub-processors: For technical processing of photos (such as hosting and LLM models).
In accordance with the DPA, we enter into appropriate contracts and guarantee that they do not use your data for training purposes. -
Transfers outside the EEA:
If a sub-processor processes outside the EEA, Snapsale applies SCCs or other appropriate safeguards (GDPR art. 44-49). -
Payment service providers: For processing subscription costs.
- Authorities: If legally required.
All storage and processing takes place within the European Economic Area (EEA).
Our primary hosting is located in data centers within the EEA, currently in [specific region, such as "Western Europe (EU) on Microsoft Azure/AWS"].

5. Your Rights as a Data Subject
Under the GDPR, you have the following rights:
- Right of access
- Right to rectification
- Right to erasure (right to be forgotten), except where we are legally required to retain data
- Right to object to processing based on legitimate interest
- Right to restriction
- Right to data portability

Where Snapsale processes data based on consent, you can always withdraw that consent (without retroactive effect).

8. Cookies and Tracking
Snapsale uses functional and analytical cookies to ensure the website works properly and to collect anonymized statistics about usage. Analytical cookies are only used based on legitimate interest and are not used to profile individual users.
